Bespoke Builds – Terms & Conditions

These Terms & Conditions govern the purchase of Bespoke Builds listed on BoomRacing.com (“Bespoke Build”). By completing a purchase, the buyer (“Buyer”) agrees to the following: 

1. Nature of Bespoke Builds 

1.1 Bespoke Builds are one-of-one, hand-built RC vehicles created by independent builders using Boom Racing chassis platforms. 

1.2 Boom Racing acts as a marketplace facilitator. The independent Builder is the product owner and seller of the completed build. 

1.3 Each Bespoke Build is unique and cannot be replicated, restocked, or exchanged once sold. 

2. Final Sale – No Returns or Refunds 

2.1 All Bespoke Builds are sold on a strict final sale basis, except where prohibited by applicable law. 

2.2 No cancellations, returns, exchanges, or refunds will be accepted for any reason, including buyer’s remorse, dissatisfaction, tuning preferences, or cosmetic concerns. 

2.3 By completing the purchase, Buyer acknowledges that the build is purchased in its listed condition based on the photos, specifications, and description provided. 

3. Buyer Responsibility Before Purchase 

3.1 Buyer is responsible for reviewing: 

• All listing photos 
• Full parts list 
• Specifications 
• Disclosures 
• Shipping terms 
• VAT and tax terms 

3.2 Buyer is responsible for asking any questions prior to purchase. 

3.3 Failure to perform due diligence prior to purchase does not constitute grounds for cancellation, return, or refund. 

4. Limited Remedy for Undisclosed Material Defects 

4.1 Buyer shall have seven (7) calendar days from confirmed delivery to notify Boom Racing in writing of any alleged undisclosed material defect. 

4.2 A material defect is defined as a defect that: 

• Was not disclosed in the listing; and 
• Substantially impairs the core mechanical functionality of the build. 

4.3 The following do not constitute material defects: 

• Cosmetic variations visible in listing photos 
• Minor imperfections 
• Normal mechanical tolerances 
• Setup adjustments or tuning preferences 
• Subjective dissatisfaction 
• Damage caused after delivery 
• Issues resulting from misuse or improper operation 

4.4 If a verified undisclosed material defect is identified within the 7-day period, Boom Racing may, in its sole discretion: 

• Facilitate troubleshooting with the Builder 
• Facilitate repair coordination 
• Arrange replacement of specific defective components 

4.5 Refunds or returns will not be provided. 

5. Shipping and Risk of Loss 

5.1 Bespoke Builds are shipped directly by the Builder. 

5.2 Shipments are insured and require signature confirmation upon delivery. 

5.3 Risk of loss transfers to Buyer upon confirmed delivery to the shipping address provided at checkout. 

5.4 Buyer is responsible for ensuring the delivery address is secure and accurate. 

6. Warranty and Support 

6.1 Bespoke Builds are custom assembled by independent Builders. 

6.2 Boom Racing does not provide warranty service, repairs, replacements, or technical support for Bespoke Builds beyond the limited facilitation described in Section 4. 

6.3 Warranty coverage, if any, is limited to original equipment manufacturers (OEM) for individual components where applicable. 

6.4 Buyer assumes responsibility for maintenance, setup, tuning, and proper operation. 

7. Chargebacks and Payment Disputes 

7.1 By completing a purchase, Buyer agrees not to initiate unwarranted chargebacks or payment disputes. 

7.2 In the event of a dispute, Boom Racing reserves the right to provide transaction records, listing documentation, delivery confirmation, and related evidence to the payment processor. 

7.3 Fraudulent or abusive chargebacks may result in account suspension and legal action. 

8. Limitation of Liability 

8.1 To the maximum extent permitted by law, Boom Racing shall not be liable for indirect, incidental, consequential, or punitive damages arising from the purchase or use of a Bespoke Build. 

8.2 Boom Racing’s total aggregate liability, if any, shall not exceed the commission earned by Boom Racing on the applicable transaction. 

9. Product Use and Assumption of Risk 

9.1 RC vehicles contain mechanical and electrical components that require responsible handling. 

9.2 Buyer assumes all risks associated with operation, maintenance, modification, and use after delivery. 

9.3 Boom Racing is not responsible for damage, injury, or loss resulting from misuse, improper setup, modification, or operation. 

10. Governing Law 

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
